These terms and conditions apply between you, the User of this Website (including any sub-domains, unless expressly excluded
by their own terms and conditions), and Barclays Dramatic Society (The Spread Eagle Players), the owner and operator of this
Website. Please read these terms and conditions carefully, as they affect your legal rights. Your agreement to comply with
and be bound by these terms and conditions is deemed to occur upon your first use of the Website. If you do not agree to be
bound by these terms and conditions, you should stop using the Website immediately.
In these terms and conditions, User or Users means any third party that accesses the Website and is not either (i) employed by
Barclays Dramatic Society and acting in the course of their employment or (ii) engaged as a consultant or otherwise providing services to
Barclays Dramatic Society and accessing the Website in connection with the provision of such services.
You must be at least 18 years of age to use this Website. By using the Website and agreeing to these terms and conditions, you represent
and warrant that you are at least 18 years of age.
Your Barclays Dramatic Society membership will continue year-to-year until terminated.
You must provide a current, valid, accepted method of payment, which you may update from time to time ("Payment Method").
Unless you cancel your membership before your annual billing date, you authorize us to charge your next year's membership fee to your Payment Method (see "Cancellation" below).
You can find specific details regarding your Barclays Dramatic membership by visiting our website and clicking on the "My Account" link available at the top of the pages of the Barclays Dramatic Society website.
Paid membership gives the member the right to purchase tickets for their own personal use for productions and social events at a discounted rate and to audition for productions without paying a further fee. The
number and frequency of productions, auditions and social events is not guaranteed.
The benefits of membership may not be transferred to another member or a non-member.
Billing Cycle. The membership fee for The Barclays Dramatic Society and any other charges you may incur in connection with your
use of the service, such as taxes and possible transaction fees, will be charged on an annual basis to your Payment Method on the calendar day
corresponding to the commencement of the paying portion of your membership. In some cases your payment date may change, for example if your
Payment Method has not successfully settled or if your paid membership began on a day not contained in a given month. Visit our website and
click on the "My Account" link to see your next payment date.
Payment Methods. You can change your Payment Method by visiting our website and clicking on the "My Account" link.
If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not change your Payment Method
or cancel your membership, we may suspend your membership benefits until we have obtained a valid Payment Method. When you update your
Payment Method, you authorize us to continue charging the updated Payment Method, and you remain responsible for any uncollected amounts.
This may result in a change to your payment billing dates. For some Payment Methods, the issuer of your Payment Method may charge
you certain fees, such as a foreign transaction fee or other fees relating to the processing of your Payment Method.
Local tax charges may vary depending on the Payment Method used. Check with your Payment Method service provider for details. The Barclays
Dramatic Society is not responsible for your card issuer or bank charging you as a result of our processing of your credit/debit card
payment in accordance with your order.
Other Charges. The Barclays Dramatic Society may charge your selected payment method for other services
you use (including, but not limited to the payment of show fees when you sign up to audition). Under such circumstances you will be
informed that the service will incur a charge on your payment method before you agree to the service.
Cancellation. You can cancel your Barclays Dramatic Society membership at any time, and you will continue to receive the
benefits of membership through the end of your annual billing period. To the extent permitted by the applicable law, payments are
non-refundable and we do not provide refunds or credits for any partial-year membership periods. To cancel, go to the "My Account" page
and follow the instructions for cancellation. If you cancel your membership, your membership will automatically end at the end of your
current billing period. To see when your membership will end, go to the "My Account" page.
Changes to the Price and Service Plans. We may change our membership benefits and the price of our service from time to time;
however, any price changes or changes to our service plans will apply to you no earlier than 30 days following notice to you.
A "production ticket" means a ticket that has been purchased from us in order to watch a performance of one of our productions.
Your order constitutes an offer to the Barclays Dramatic Society to buy the relevant product. All orders are subject to availability
and to acceptance by The Barclays Dramatic Society. The contract for purchase of the product is only entered into when the The Barclays
Dramatic Society sends you an email confirming acceptance of your offer or display to you a confirmation screen confirming
acceptance of your offer.
The Barclays Dramatic Society reserves the right to cancel or not accept an order for any reasonable reason (including, but not limited
to where we have not been able to obtain authorisation for payment or a product is out of stock). If we cancel your purchase,
you will be refunded in accordance with these terms.
The price of a product shall be as stated on this website at the time you place your order except in the case of obvious error.
Our prices may change at any time but price changes will not affect orders we have confirmed with you. If the price of a product is obviously wrong,
we will not be obliged to provide the product to you at that price and will give you the option of confirming your order at the correct
price or cancelling your order, in which case you will be refunded the price of the ticket.
The Barclays Dramatic Society is not responsible for your card issuer or bank charging you as a result of our processing of your credit/debit card
payment in accordance with your order.
The Barclays Dramatic Society does not guarantee the assignment of a particular seat upon fulfillment of an order.
Member production tickets are production tickets that are discounted for the personal use of the member purchasing them.
Member production tickets may only be bought by a member who is currently a paying member of the society. A member production ticket may not
be transferred to another member or a non-member.
Audition and Cast Payments
A "successful" auditionee is someone who has been offered a role/s in a production and confirm that they will take one or more of the
offered role/s in person, by email or by some other means
Non-members and members who do not pay a subscription will be charged a fee for auditioning for our productions. This fee is non-refundable
whether the person is cast in the show or not.
For the avoidance of doubt, becoming a paying member after an audition fee has been paid does not entitle the auditionee to a refund of
the audition fee. However, potential auditionees may become paying members prior to signing up to audition in order to avoid the
Successful auditionees agree to being charged a show fee which will be advertised for each production prior to auditionees signing up.
Paying members who register to audition agree to pay a show fee from their subscription payment method upon agreeing to a role.
Auditionees agree that should they be successful that they must be paying members for at least the period of the prodution's rehearsals and
run. The minimum membership term is one year; a member may not pay membership fees pro-rata in the event that the rehearsal period is shorter.
A paying membership that was started due to being successfully cast in a production will not be refunded in the event that the member
leaves the production.
Should the successfully cast auditionee decide to withdraw from a production during the rehearsal period or the performance period, the show fee
will not be refunded.
Should the auditionee who has been cast in a production be asked to leave the production then the show fee will be refunded at the discretion of the
Barclays Dramatic Society committee. It will not be unduly withheld.
From time to time, The Barclays Dramatic Society will organise social events for member and/or non-members. The Barclays Dramatic
Society offers no guarantee of the frequency or type of events offered.
Some social events will have a limited number of tickets and will be offered on a first come, first served basis.
Where discounted tickets for a social are offered to members, those tickets may only be bought by paying members. Once bought they may not
be transferred to any other member or non-member. Each member may only purchase one member ticket for their own use.
Purchased tickets may not be refunded.
Intellectual property and acceptable use
All Content included on the Website, unless uploaded by Users, is the property of Barclays Dramatic Society,
our affiliates or other relevant third parties. In these terms and conditions, Content means any text, graphics,
images, audio, video, software, data compilations, page layout, underlying code and software and any other form of
information capable of being stored in a computer that appears on or forms part of this Website, including any such content uploaded by Users.
By continuing to use the Website you acknowledge that such Content is protected by copyright, trademarks, database rights and other
intellectual property rights. Nothing on this site shall be construed as granting, by implication, estoppel, or otherwise,
any license or right to use any trademark, logo or service mark displayed on the site without the owner's prior written permission.
You may, for your own personal, non-commercial use only, do the following:
